Testimony of Charles Dolan

Charles Dolan took the stand first and said that he had been robbed twice—first on November 26, 1980 and then again on March 27, 1981. At the time of the robberies Dolan said he sold marijuana for a living.
He testified that during the first armed robbery he was home alone, lying on his couch watching TV, when the door burst open and two men wearing ski masks entered his home. One of them stuck a rifle in his face and told him to get on the floor. He said they wrapped nearly his whole body in some brownish-green plastic tape; only his mouth was uncovered. He said he was kicked in the ribs once or twice before he told them where a couple pounds of marijuana could be located in a footlocker.
In the bottom of the footlocker was an orange safe. They brought that into the room where he was lying on the floor and dropped it very close to his head. It weighed about a hundred pounds and it made a hole in the floor underneath the rug when the corner of it hit the floor.  He told them there was nothing in it.
He said one of them went through his pockets where he had a few hundred dollars and they took that. He then told them that there was a bag of money underneath the seat in his pickup truck and some under the bureau in the bedroom.
In all Dolan said the men got about $20,000. Dolan said while the robbers were in his home the phone rang four or five times and they just ripped the phone out of the wall to silence it.
He said after they left, he was able to work his hands free of the tape and then took the tape off his head and body. He then got in his vehicle and drove to a nearby friend’s house. Dolan was not able to identify his attackers, but he knew they were men.
